Dear Governor Schwarzenegger,


I am writing to you today because of my concern about an incredible injustice 
I recently heard about on the O'Reilly Factor show with Bill O'Reilly.

The incident, as discussed with Robert Duvall and Diane Rose, 
occurred on May 10, 2004 within the Palo Alto Superior Court, Dept 89 on
case #030333, defendant Brendon Rose. Brendon is a 20-year-old young man
who was sentenced to 8 years in the California state prison system for his
participation in a fight on the Santa Clara College University campus in March,
2003. My hope is that you will direct an investigation into this matter and help
right this horrible wrong.

Brendon was ill-advised by his hired attorney to plead no contest to the charges
presented by the District Attorney. Therefore, his side of the incident and a
true understanding of his character were never revealed. As you well know, the
legal system is based on checks and balances and it is important to understand
both sides when making a decision on a just punishment.

Brendon is an excellent student and a hard worker with no past record of violence.
He has always been an asset to his community and has been recognized as a leader
by his peers, teachers, and coaches. He has served as a volunteer coach and
referee and has participated in many service projects at the local senior center.
This young man has truly made a difference in his community and that community
has come out in vast numbers to protest his extreme sentence.

If Brendon serves 8 years in state prison, he will come out a different man. His
innocence and naivete will be gone. He will not be able to continue his college
education and his job opportunities will be greatly affected by his record. Why
would society want to take a productive, positive contributor and put him away for
8 years? Why would society want to negatively impact the future of a good young
man? Why would society want to pay for an expensive, excessive, and unnecessary
prison sentence?

I am not suggesting that Brendon not suffer any consequences, only that 8 years
in state prison is extreme and a loss for his community. At this time, Brendon's
new lawyer is appealing to the Honorable Judge Diane Northway to allow the no-
contest plea to be vacated, thus giving Brendon Rose the opportunity to have a
new trial with a qualified, responsible defense. Any help you can give us to
right this injustice would be greatly appreciated.
